Property owners associations (POAs) and management
companies are particularly vulnerable to cyberattacks due to their lack
of a strong IT structure and the amount of sensitive homeowner Personal
Identifying Information (PII) held throughout their systems. POAs
should be preparing for the eventuality of a cyberattack by
understanding what defines PII, the laws Texas has relating to
cyberattacks and the potential ramifications for the organizations
attacked, as well as steps that can be taken to protect PII and prevent
cyberattacks.

Attorneys Secure Property Owners Associations' Right to Amend Governing

On January 26, 2024, RMWBH attorneys Greg Godkin and
Ashley Koirtyohann secured a major win for the POA industry when the
Supreme Court of Texas denied a Petition for Review in Chu v.
Windermere Lakes Homeowners’ Association, Inc. At the heart of the case
was the question of whether a POA’s members have the power to amend the
POA’s declaration to impose new restrictions against existing owners.

Understanding
the Corporate Transparency Act
The Corporate Transparency Act is a new federal law that
went into effect on January 1, 2024. The law adds reporting
requirements for corporations and their beneficial owners. As of now,
this includes most POAs.

explains the requirements of the Corporate Transparency Act, details
who qualifies as a beneficial owner, the deadlines to comply with this
new law and financial and legal ramifications if the law is not
complied with.
