to Watch for in Pool MSAs in the Age of High Insurance Rates

Spring is almost here and in
Texas that means higher temperatures and the opening of community pools
are right around the corner. Before pool season gets into full swing,
property owners associations (POAs) should be reviewing their Pool
Management and Maintenance Master Services Agreement (Pool MSA) to
ensure that the contract adequately addresses the level of risk
associated with operating a pool. In this article, we will review
several of the items that POA managers and board members should look
for in the Pool MSA regarding insurance.

Highlight - Jane Janecek
The attorneys of RMWBH have
created a foundation clients have depended on for over 40 years. A
building block for that foundation, and a person crucial to the firm’s
future success, is Shareholder Jane Janecek. Jane has risen through the
RMWBH ranks, initially joining the firm as an Associate Attorney at
Butler Hailey. After spending 10 years in Tyler working for a local
real estate firm, she rejoined the newly formed RMWBH in 2016 as Senior
Counsel. Fast forward to today, and Jane is a Shareholder and leader on

Contracting
with Pool Vendors in the Age of High Insurance Rates
As spring approaches, POAs should be reviewing their pool
management and maintenance service agreements (Pool MSAs) to ensure
they are ready for the season ahead. An important aspect of the Pool
MSA to focus on is the amount of insurance the pool vendor carries to
ensure it meets the requirements of the POAs.
