Update Your Policies as New Laws Go Into Effect

A helpful reminder from RMWBH's POA attorneys. September 1st in a legislative year is the traditional date many new laws go into effect, and this September 1st is no different. As a result, POAs need to be sure their policies are updated to correspond to the new requirements. This year, that means single-family POAs, governed by Chapter 209, need to update their Collection Policy. Plus, for those POAs with fining authority set forth in their governing documents, a fine policy will need to be adopted or updated by January 1, 2024. Also, if your POA has not adopted policies from the 2021 legislative session, NOW is the time to get in compliance for those. What Board Members Need to Know on POA Budget Season

The start of fall for many marks the hope of cooler temperatures being near, but for POA community managers and board members that is another story. September means the heat is really cranked up with the stress of budget season falling upon the POA industry. The requirements on how the budget should be set depend on a number of factors in both the Texas Property Code and the governing documents of the specific association. In this article, we detail the requirements found in Chapter 82 and Chapter 209 of the Texas Property Code, the roles and responsibilities the Board plays, and how preparing for the future could save potential heartache in the years ahead.
